These terms are the agreement between you and Innolex Corp. s.r.o., Budovcova 188/1, 130 00 Praha, Czech Republic (“Gemut”, “we”, “us”) for the Gemut app for iPhone and the website gemut.health. By creating an account or using Gemut, you accept them. If you do not agree, please do not use Gemut. How we handle your data is described in our Privacy Policy.

1. What Gemut is

Gemut helps you understand your test results. You upload lab reports and other medical reports; Gemut reads them and shows every value with its range and a status. It works out your Gemut Age and calculated indexes, and keeps your tests side by side over time. Noa, Gemut’s AI assistant, answers questions about your results in Health mode and helps you think through how you feel in Mental mode. Gemut can also suggest a protocol: supplements, nutrition and habits based on your results.

2. Not medical advice

  • Gemut is an information and wellness service. It is not a medical device and does not diagnose, treat, cure or prevent any disease.
  • Statuses, scores, Gemut Age, indexes, reviews, protocols and Noa’s answers are information to discuss with your doctor, not medical advice. Do not start, stop or change a medication, or ignore your doctor’s advice, because of something you read in Gemut.
  • Noa’s Mental mode offers educational support. It is not therapy and not crisis help.
  • In an emergency, call your local emergency number, for example 112 in the EU or 911 in the US.

Please also read our Medical Disclaimer.

3. AI and accuracy

Gemut uses AI from third-party providers, named in our Privacy Policy, to read documents and to write explanations. AI can misread a value, miss a result or be wrong. Check values against your original report before you rely on them. Statuses are based on the reference range printed on your report; where a report gives none, Gemut uses standard adult ranges. For some values Gemut also shows a narrower optimal range, taken from published guidelines or, for a few values, set by Gemut. These ranges may not fit your situation.

4. Who can use Gemut

  • You must be at least 18 years old.
  • An account is for one person, and Gemut is made for your own results: upload only documents about yourself.
  • Give accurate information in your profile. Some results, such as your Gemut Age, depend on it.

5. Your account

  • You sign in with Apple or with an email address and a password. Keep your sign-in details safe: you are responsible for what happens in your account. If you think someone else is using it, write to us.
  • You can delete your account at any time in the app, under More → Settings → Legal & data → Delete my account. It is erased 30 days later; until then you can cancel the deletion by signing in and choosing Cancel deletion.
  • Deleting your account does not cancel a subscription bought in the App Store. Cancel it in your Apple ID settings.

6. Free features and Gemut Plus

  • Some of Gemut is free, for example your first blood test. Other features, and other kinds of documents such as urine tests or MRI reports, need Gemut Plus, a subscription; the app shows which ones.
  • Gemut Plus is sold monthly or yearly through Apple’s App Store. The price, the billing period and any free trial are shown in the app, in your currency, before you buy.
  • Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically at the end of each period unless you turn off automatic renewal at least 24 hours before the period ends; the renewal is charged within the last 24 hours of the period.
  • If you start a free trial, it becomes a paid subscription when the trial ends, unless you cancel at least 24 hours before that.
  • You manage and cancel your subscription in your Apple ID settings. After you cancel, you keep Plus until the end of the period you paid for.
  • Apple handles payments and refunds for App Store purchases under its own terms; you can ask Apple for a refund at reportaproblem.apple.com. We cannot refund App Store purchases ourselves.
  • We may change prices and what Plus includes. Price changes follow Apple’s rules: Apple tells you in advance, and where the rules require your consent to a higher price, it applies only if you agree.

7. Fair use

To keep Gemut fast and available to everyone, we may limit unusually heavy use, such as a very large number of uploads or messages in a short time. This also applies to Gemut Plus. Uploading the same file again does not create a new test.

8. Your content

  • The documents and information you add to Gemut remain yours.
  • You allow us to store, copy, process and display them, and to have our service providers process them as described in our Privacy Policy, only to provide Gemut to you. This permission ends when the content is deleted.
  • We do not sell your content, and neither we nor our AI providers use it to train AI models.
  • You are responsible for having the right to upload what you upload.

9. Acceptable use

You must not:

  • use Gemut for anything illegal or harmful, or upload content that infringes the rights of others;
  • upload documents about another person;
  • try to get around limits, payments or security, or to access data that is not yours;
  • copy, modify, reverse engineer, resell or redistribute the app, except where the law allows it;
  • use bots or scrapers, or overload the service.

We may suspend or close an account that breaks these rules.

10. Our app and our content

The app, the website, their design and texts, the names Gemut and Noa and our logos belong to Innolex Corp. s.r.o. or its licensors. We give you a personal, non-exclusive, non-transferable licence to use the Gemut app on Apple devices that you own or control, under these terms and Apple’s Usage Rules. The scientific sources we cite belong to their authors. If you send us ideas or feedback, we may use them freely.

11. Changes to Gemut

Gemut depends on providers such as Apple and our hosting and AI providers. We work to keep it running, but we cannot promise that it will always be available or free of errors. We may add, change or remove features; if we remove a feature of Gemut Plus, we will tell you in advance.

12. Ending the agreement

You can stop using Gemut and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it, with notice where we can give it. If we stop offering Gemut, we will tell you in advance and give you time to get a copy of your data.

13. Liability

  • Gemut is provided as it is, to the extent the law allows.
  • We are not liable for health decisions made on the basis of information in Gemut, for errors in AI-read values or in reference ranges, or for indirect or consequential losses.
  • Otherwise, our total liability to you is limited to the amount you paid for Gemut in the 12 months before the claim.
  • Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, and nothing in them affects your statutory rights as a consumer.

14. App Store terms

If you downloaded the app from Apple’s App Store:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
  • Your licence lets you use the app on Apple devices you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms and Conditions.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app does not conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • Apple is not responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Apple is not responsible for investigating, defending, settling or discharging any claim that the app infringes a third party’s intellectual property rights.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes to these terms

We may update these terms. We will publish the new version here with a new date and, before significant changes take effect, tell you in the app or by email. If you keep using Gemut after the change, the new terms apply; if you do not agree, you can delete your account.

16. Law and disputes

  • Czech law applies to these terms. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your country.
  • The courts of Prague have jurisdiction. If you are a consumer, you may also bring a claim in the courts of your country.
  • As a consumer, you may also turn to an out-of-court dispute resolution body. In the Czech Republic this is the Czech Trade Inspection Authority (Česká obchodní inspekce).
  • If any part of these terms is invalid, the rest remains in force.
